Taylor Swift vs. Donald Trump: Sue Over Unauthorized Song Use in White House TikTok? (2025)

Is Taylor Swift about to take on Donald Trump in a legal battle? It seems the pop superstar might be gearing up for a showdown after her hit song, "The Fate of Ophelia," was used in a video on the official White House TikTok channel.

This isn't just any video; it's a potential copyright infringement, and it's got Swifties buzzing. The video, cheekily captioned "Our Vibes," features the song and its lyrics, seemingly without proper licensing. But here's where it gets controversial: Trump has publicly expressed his dislike for Swift, famously declaring "I HATE TAYLOR SWIFT" on his Truth Social account after she endorsed a Democrat candidate.

The 22-second TikTok clip pairs images of Trump and his associates with lyrics from the song, including the line, "Don’t care where the hell you’ve been," overlaid on Trump's 2023 mugshot. First Lady Melania Trump and Second Lady Usha Vance also appear in a collage set to Swift's music. The video culminates with Trump preparing McDonald's fries, with the song title tweaked to "the fate of America."

The White House press office, in a statement to The Wrap, seemed to revel in the controversy, stating, "We made this video because we knew fake news media brands like The Wrap would breathlessly amplify them. Congrats, you got played."

While some self-proclaimed "MAGA Swifties" cheered the video, many comments on the TikTok clip expressed outrage and urged Swift to take legal action. Fans are eager to see if she will sue.

So, what are Swift's options? She could send a cease-and-desist demand or issue a takedown notice to TikTok under the Digital Millennium Copyright Act. But here's the million-dollar question: will she actually sue? Considering her history of meticulously reclaiming her masters, and her reputation for carefully selecting brand partnerships, it's unlikely she'd have approved a sync license for the White House, especially given Trump's past social media attacks.

It's worth noting that other artists, including Bruce Springsteen, ABBA, Beyoncé, and others, have also objected to the use of their music by the Trump team. Recently, the indie rock duo MGMT successfully filed a takedown notice after their song was used in an ICE recruiting video.

Interestingly, the White House also participated in a TikTok trend featuring a mashup of 4 Non Blondes' "What's Up?" and Nicki Minaj's "Beez in the Trap," which the rapper herself applauded.

What do you think? Should Taylor Swift take legal action? Do you agree with the White House's use of her music, or do you think it's a blatant misuse of her work? Share your thoughts in the comments!
